Terms and Conditions

1. The Agreement

These Terms govern your access to and use of the Saral AI platform (app.saralhire.ai and saralhire.ai), operated by HeadsIn Connect LLP. They apply together with our Privacy Policy, incorporated by reference. By using the platform, you agree to these Terms.

2. Eligibility and Account

• You must be 18 or older and legally authorised to enter contracts
• The platform is for legitimate business recruitment only, not personal use
• All registration information must be accurate and kept up to date
• You are responsible for all activity under your account credentials
• If registering on behalf of a company, you confirm you have authority to bind that entity
• Notify us immediately at support@saralhire.ai if your account is compromised

3. Subscription Plans, Credits, and Billing

Plans

Annual plans receive a 10% discount. Current pricing at saralhire.ai/pricing.

Credit System

Credits reset each billing cycle. Unused credits do not roll over and have no cash value.

Billing

• Subscriptions are billed in advance (monthly or annual) and auto-renew
• Prices are in INR, exclusive of applicable GST
• Payment is processed by Stripe; we do not store card credentials
• Billing disputes must be raised at billing@saralhire.ai within 14 days of the invoice date
• Monthly subscriptions are non-refundable; annual subscriptions may receive a pro-rated refund within 14 days of purchase if the platform has not been actively used

4. Acceptable Use

Permitted Use

You may use Saral AI solely for legitimate professional recruitment and talent sourcing within your organisation or for clients you represent.

Prohibited Conduct

• Reselling, redistributing, or commercialising Candidate Data obtained through the platform
• Scraping, crawling, or systematically harvesting data beyond ordinary authorised use
• Using Candidate Data or AI Output to build competing databases, tools, or products
• Attempting to reverse-engineer the platform, AI models, or algorithms
• Sending spam or messages that violate anti-spam laws (IT Act, CAN-SPAM, GDPR)
• Using AI outputs to make employment decisions based on protected characteristics (gender, age, caste, religion, disability, race, nationality, or pregnancy)
• Using any Output or Candidate Data to train, fine-tune, or test external AI models
• Creating fake accounts or misrepresenting your identity or organisation

Violations may result in immediate account suspension or termination without refund.

5. Candidate Data Obligations

By accessing Candidate Data through the platform, you represent and undertake that:

• You are sourcing for a genuine, open role within your organisation or for a client you represent
• You will comply with all applicable data protection laws, including DPDP Act 2023 and GDPR
• You will include a clear unsubscribe mechanism in all outreach communications
• You will not store Candidate Data beyond what is necessary for your active recruitment process
• You will promptly honour candidate opt-out and data removal requests

6. AI Features

• All AI outputs (fit scores, switch-likelihood predictions, outreach drafts) are decision-support tools, not guarantees
• You are solely responsible for reviewing and verifying AI-generated content before acting on it
• AI outputs must not be used to discriminate based on any protected characteristic
• You must not use any Output or platform data to train, fine-tune, or test external AI models
• Enriched contact information carries approximately 83% accuracy and is not warranted

Saral AI does not make fully automated decisions with significant effects on candidates. Human judgment is always required.

7. Outreach Compliance

When using the Outreach Sequence feature, you are solely responsible for compliance with applicable laws, including India's IT Act, TCCCPR, CAN-SPAM (US recipients), and GDPR (EU recipients). You must:

• Include a clear, functional unsubscribe link in every outreach email
• Accurately identify yourself and your organisation as the sender
• Review and customise all AI-generated message drafts before sending
• Not use misleading subject lines or deceptive content

8. Intellectual Property

• All platform technology, AI models, scoring algorithms, trademarks, and documentation belong exclusively to HeadsIn Connect LLP
• You receive a limited, non-exclusive, revocable licence to use the platform for internal recruitment during your active subscription
• You retain ownership of content you submit (search queries, job descriptions, outreach templates) but grant us a licence to process it to deliver the service
• If you submit feedback or suggestions, you grant us an irrevocable, royalty-free licence to use them without restriction
• You may not copy, reproduce, distribute, or reverse-engineer any element of the platform

9. Confidentiality

Each party will protect the other's Confidential Information with at least reasonable care, using it only to fulfil obligations under this Agreement. Confidentiality obligations survive termination for 5 years (trade secrets: indefinitely). Standard exceptions apply (publicly available information, independently developed content, legally compelled disclosure).

10. Disclaimer of Warranties

The platform is provided "as is" and "as available", without warranties of any kind. Saral AI does not warrant that the platform will be uninterrupted, error-free, or that AI outputs, candidate data, or enriched contacts will be accurate or complete. Use of the platform does not guarantee successful placements or hiring outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, Saral AI and HeadsIn Connect LLP will not be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, data, or business opportunity.

Our total aggregate liability for all claims shall not exceed the total fees paid by you to Saral AI in the three (3) calendar months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify Saral AI against all claims, damages, and costs arising from:

• Your violation of these Terms or any applicable law
• Misuse of Candidate Data or claims by candidates regarding data mishandling
• Employment decisions, discriminatory or otherwise, made using platform outputs
• Misrepresentation of your identity or authority

13. Term and Termination

• You may cancel your subscription at any time via account settings or support@saralhire.ai
• Access continues until the end of the current billing period
• Saral AI may suspend or terminate your account immediately for breach of these Terms, non-payment, fraudulent or illegal activity, or if required by law
• On termination, your access ends and data is retained per the Privacy Policy before secure deletion
• Provisions on IP, confidentiality, liability, indemnification, and governing law survive termination

14. Governing Law and Disputes

• These Terms are governed by the laws of India
• Disputes will first be addressed through 30 days of good-faith negotiation
• Unresolved disputes will be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), conducted by a sole arbitrator in English
• Nothing prevents users from exercising statutory rights before the Data Protection Board of India or applicable consumer forums

15. General Provisions

• These Terms, together with the Privacy Policy and any Order Form, constitute the entire agreement between the parties
• You may not assign your rights under these Terms without our written consent
• Failure to enforce any provision does not constitute a waiver
• Material amendments will be communicated 14 days in advance via email or in-platform notice; continued use constitutes acceptance
• These Terms are in English; the English version prevails in case of any conflict with a translation
